PEETNIK REWARDS TERMS & CONDITIONS
Effective Date: October 6, 2021
The Peetnik Rewards Program (the “Program”) allows members to receive Peetnik Rewards Points (“Points”) which can then be redeemed for complimentary Peet’s items or discounts (“Reward” or “Rewards”) at participating Peet’s stores.
The Peetnik Rewards Program Terms and Conditions (these “Terms and Conditions”) set forth the terms and conditions, including an Arbitration Agreement, applicable to the “Program,” available through the Peet’s mobile app (the “App”). In these Terms and Conditions, “you” and “your” refer to the person who has registered for the Program. “We,” “us” and “our” refer to Peet’s Coffee, Inc., a Virginia corporation.
1. PROGRAM MEMBERSHIP QUALIFICATIONS
You must be at least thirteen (13) years of age and reside in the United States to register for the Program. Only Peet’s Coffeebar consumers may register for the Program. Participation in the Program requires download and use of App for iOS or Android devices. You can download the App from the Apple App Store® or Google Play™ store.
2. COMMUNICATIONS REGARDING THE PROGRAM
Program Communications By participating in the Program, you agree to receive communications from Peet’s, including emails and push notifications, regarding the Program and concerning offers and promotions that may be of interest to you. If you opt out of receiving emails and decline to receive push notifications from the App, you may be precluded from participating in and receiving some or all of the benefits of the Program. You are responsible for keeping your contact information up to date with Peet’s. Lost, stolen or expired Rewards, Points and Promotional Offers will not be replaced. Peet’s is not responsible for communications, including Points, Rewards, and Promotional Offers lost due to changes of address or other contact information.
Delivery Communications By placing a delivery order using the Peet’s App, you agree to receive non-marketing delivery communications from Peet’s or its third-party service providers including via text message and calls to the cellular telephone number you provide at checkout. To opt out of receiving text messages regarding your delivery order, you can reply “STOP” from the mobile device receiving the messages. Standard data and message rates apply.
3. REGISTERING FOR THE PROGRAM
You may register for the Program and create your account (“Account”) via the App. We will ask you to provide a phone number and date of birth. You will also be asked to create a password. You must register before you can receive Points.
4. RECEIVING POINTS
To receive Points when you order at participating Peet’s locations, you must either (a) scan the QR code in the App or (b) provide the phone number associated with your Account (if any) at the point of sale prior to payment. To receive Points when you order via Peet’s “Mobile Order Ahead” option, no additional action is required.
You will receive 1 (one) Peetnik Rewards point (a “Point”) for every $1 (one) U.S. Dollar you spend at participating Peet’s locations.
You may accrue more than 1 (one) Point for every $1 (one) U.S. Dollar from time to time through Promotional Offers or Points multipliers and bonuses.
Certain exclusions apply. For example, Reward redemptions, gift card purchases (physical or electronic), Peet’s stored value cards (activations or reloads), peets.com purchases, order.peets.com purchases, grocery store purchases, discounts, taxes, tips, delivery fees, charitable donations, bag fees, cup fees, and recycling deposits, are excluded and ineligible for Point accrual. You will also not receive Points for purchase transactions at non-participating locations, such as licensed partners and Proudly Pouring locations that are owned and operated by third parties.
Except as set forth in the “Mobile Order Ahead” paragraph below, tender for your purchases may be in cash, credit or debit card, via Apple Pay®, or a Peet’s stored value card (physical or digital). Points received will be posted to your Account not later than twenty-four (24) hours after the applicable qualifying purchase.
Mobile Order Ahead You can order ahead by downloading the App and joining the Peetnik Rewards program to use the Peet’s Mobile Order Ahead option (“Mobile Order Ahead”). You must pay for any Mobile Order Ahead order with a credit or debit card, Apple Pay, or a digital Peet’s stored value card.
6. REDEMPTION TIERS
You may redeem Points for Rewards based on the following redemption tiers. Item availability may vary by location, and redemption tiers and items may be adjusted from time to time in Peet’s sole discretion:
25 POINTS may be redeemed for one (1) of the following drink customizations to a full-sized beverage:
Added espresso shot
Added dairy alternative (e.g., almond milk, oat milk or soy milk)
Added sauce (e.g., caramel sauce)
Added syrup (e.g., hazelnut syrup or honey)
Added topping (e.g., whipped cream)
Drink customizations may not be redeemed as a standalone beverage.
50 POINTS may be redeemed for one (1) of the following items:
A baked good (e.g., a croissant or muffin)
Plain iced tea
Cold brewed coffee
1 off your current order of $1 (pre-tax) or more
Iced Tea Shakers, Nitro on tap, and Cold Brew lattes are excluded from this redemption tier.
120 POINTS may be redeemed for one (1) of the following items:
Espresso or espresso-based beverage (e.g., a caffe latte)
Tea beverage (e.g., Tea Shakers, Tea Lattes)
Warm breakfast item (e.g., breakfast sandwich or oatmeal)
$3 off your current order of $3 (pre-tax) or more
200 POINTS may be redeemed for one (1) of the following items:
One 10-count box of Peet’s K-Cup® Pods
One 10-count box of Peet’s Espresso Capsules
$5 off your current order of $5 (pre-tax) or more
400 POINTS may be redeemed for:
One (1) one pound bag of Peet’s coffee beans (whole bean or ground) or one half (1/2) pound bag of Peet’s Reserve Coffees.
7. REDEEEMING REWARDS
To redeem a Reward, you must, at the time of purchase, (a) first convert eligible points into a Reward by tapping the “Use Points” button on the desired reward and (b) then apply the Reward to your in-store or Mobile Order Ahead transaction by selecting the “In-store” or “Mobile Order” button. For in-store purchases you must then scan the QR code in the App. For Mobile Order Ahead transactions the Reward will be applied when you checkout.
You may only redeem one Reward or offer per transaction. A Reward redemption will apply to the most expensive item in an order which includes multiple redemption options. For example, when redeeming within the 25 Point tier, a caffe latte order with both an added espresso shot and an alternative milk will result in the Reward being applied to the more expensive of the beverage modifier (i.e., the added espresso shot or alternative milk).
8. BONUS REWARDS AND POINTS
Program members are eligible for the following bonuses (each a “Bonus”):
Welcome Bonus After scanning the QR code in the App during your first purchase, we will post a one-time welcome bonus of 125 Points to your Account (the “Welcome Bonus”). Transactions must be more than $0 to earn 125 points.
Birthday Bonus We will post a birthday bonus of 25 Points (the “Birthday Bonus”) on your birthday (as noted in your Account), subject to the following conditions:
You must have provided your birthdate at the time of registration of your Account.
Your birthday must be at least seven (7) days after the date of the registration of your Account.
You must have scanned the QR code in the App during an in-store purchase or completed a Mobile Order Ahead transaction at least once in the 180 days prior to your birthday.
Birthday Bonus is not provided retroactively.
You are eligible to receive one (1) Birthday Bonus per year.
Anniversary Bonus After presenting your digital Account and completing your first purchase, we will post a bonus for a complimentary baked good or beverage on each anniversary after your initial Account registration (the “Anniversary Bonus”), subject to the following conditions:
You must have scanned the QR code in the App during an in-store purchase or completed a Mobile Order Ahead transaction (a) prior to your first anniversary and (b) after your last registration anniversary.
The Anniversary Bonus must be redeemed within seven (7) days of posting to your Account.
Bottled beverages are excluded from the Anniversary Bonus.
To redeem an Anniversary Bonus, you must select the Anniversary Bonus in the App and apply it to your in-store or Mobile Order Ahead transaction.
9. PROMOTIONAL OFFERS
We may post certain promotional offers (“Promotional Offers”) to your Account. Promotional Offers will be subject to the terms and conditions of each respective Promotional Offer, including, without limitation, qualifying purchases and applicable expiration dates.
To redeem a Promotional Offer, you must choose the applicable Promotional Offer from the App and apply it to your in-store or Mobile Order Ahead transaction.
10. REDEMPTION RESTRICTIONS
You may not redeem Points, Rewards, Bonuses, or Promotional Offers for cash, except as otherwise required by law, and they have no cash value. You do not own Points, Rewards, Bonuses, or Promotional Offers, which can be changed or eliminated by Peet’s at its discretion at any time. You may not use Points, Rewards, Bonuses, or Promotional Offers to satisfy any requirement of any Promotional Offer that requires you to purchase any item. For example, if you have received a buy-one-get-one-free Promotional Offer, you may not use Points, a Reward, a Bonus, or Promotional Offer for one item and then receive one free as part of the Promotional Offer. Points, Rewards, Bonuses, and Promotional Offers cannot be combined with any other type of promotion or offer that may be offered from time-to-time by Peet’s outside of the Peetnik Rewards program. You may only redeem one (1) Reward or Promotional Offer per transaction.
11. EXPIRATION OF POINTS, REWARDS, BONUSES, AND PROMOTIONAL OFFERS
Points If you do not either (a) check-in by scanning the QR code in the App and making a purchase at a participating Peet’s store or (b) complete a purchase with Peet’s “Mobile Order Ahead” option, in each case for a period of 180 days, then all unredeemed Points available on your Account (including Welcome Bonuses and Birthday Bonuses) will expire and be removed from your Account. If you have questions regarding the date of your last Peetnik Reward check-in or Mobile Order Ahead purchase, please check the Account Activity section in the App.
Rewards Rewards shall expire one (1) day following conversion from Points.
Anniversary Bonus The Anniversary Bonus shall expire seven (7) days after being posted to your Account.
Promotional Offers Promotional Offers shall expire in accordance with their respective terms and conditions.
12. LOADING YOUR DIGITAL CARD
When you sign up for Peetnik Rewards, you are assigned one (1) digital Peet’s card to be used through the App. You may add value to your digital card from existing Peet’s cards via the App or online at www.peets.com.
13. BALANCE INQUIRY AND TRANSACTION HISTORY
The Points available at any time in your Account will equal the aggregate number of Points received less the aggregate number of Points redeemed (the “Available Points Balance”). The Rewards available at any time in your Account will equal the aggregate (a) Rewards, Bonuses and Promotional Offers less the aggregate (b) redeemed and/or expired Rewards, Bonuses, and Promotional Offers (“Available Rewards Balance”).
You may check the Available Points Balance and Available Rewards Balance via the App or online at https://account.peets.com/login. Your Available Points Balance and Available Rewards Balance shall equal the amounts reflected in our records unless you can prove otherwise to our satisfaction. If you are interested in the complete transaction history of your account, contact us at firstname.lastname@example.org or (800) 999-2132.
14. UNAUTHORIZED ACCESS OR USE
We are not responsible for any unauthorized access to your Account or any unauthorized use of any Points, Bonuses, Rewards, or Promotional Offers in your Account. If you believe any such unauthorized access or use has occurred, you may notify us at email@example.com or (800) 999-2132. Upon receipt of such notification, we will help you to set up a new Account and transfer your Available Points Balance and Available Rewards Balance (if any). However, we will not reinstate Rewards, Bonuses or Promotional Offers that were redeemed by an unauthorized user of your Account.
15. CANCELLING YOUR MEMBERSHIP IN THE PROGRAM
You may cancel your membership in the Program by contacting us at firstname.lastname@example.org or (800) 999-2132. Once you have cancelled your membership in the Program, you shall not receive additional Points in your Account, and the Available Points Balance in your Account shall immediately expire. Additionally, you will not be able to redeem any Available Rewards or Promotional Offers present at the time of account cancellation.
16. NO TRANSFERS
Points, Rewards, Bonuses, and/or Promotional Offers may not be transferred.
17. REVOCATION AND TERMINATION OF ACCOUNT OR PROGRAM
We reserve the right to cancel, terminate, suspend, or revoke your Account at any time in our discretion, without prior notice, subject to applicable law. Upon cancellation, termination, suspension, or revocation of your Account, you shall not receive additional Points in your Account, and the Available Points Balance, the Available Rewards Balance, and Promotional Offers in your Account shall immediately expire.
We reserve the right to cancel, terminate, or suspend the Program at any time in our discretion, upon thirty (30) days’ prior notice. Upon cancellation, termination, or suspension of the Program, you shall not receive additional Points, and the Available Points Balance in your Account shall immediately expire. Upon cancellation, termination, or suspension of the Program, you will no longer be able to redeem any valid Available Rewards Balance or Promotional Offers present in your Account at the time.
18. ARBITRATION IF A DISPUTE ARISES (“ARBITRATION AGREEMENT”)
Scope of Arbitration Agreement. Any legal dispute between you and Peet’s concerning or arising out of the Program, including the App, your Account, and the Points, Rewards, Bonuses, and Promotional Offers, including any other communications between you and Peet’s, shall be resolved through binding individual arbitration unless you opt out of this Arbitration Agreement using the process explained below. You understand and agree that you are waiving your right to sue or go to court to assert or defend your rights. However, either you or Peet’s may bring any individual claim in small claims court consistent with the jurisdictional and dollar limits that may apply, so long as it is brought and maintained as an individual claim.
Right to Opt Out of this Arbitration Agreement. You may opt out of this Arbitration Agreement within the first sixty (60) days after you register for the Program or sixty (60) days after any material change to these Terms and Conditions, as indicated by a new effective date of these Terms and Conditions, by calling or sending a letter to Peet’s at the phone number or address listed below. If you send a letter to Peet’s, you will need to include your printed name and mailing address, and the words “Reject Arbitration.”
Informal Dispute Resolution. Either party asserting a dispute shall first try in good faith to resolve it by providing written notice as specified below to the other party describing the facts and circumstances (including any relevant documentation) and allowing the receiving party thirty (30) days to respond. Notice shall be made by first class or registered mail (a) to Peet’s at the address below and (b) to you at the email address on file with Peet’s. This informal dispute resolution requirement is a prerequisite to any arbitration; you and we must provide with any arbitration demand a copy of the notice of dispute and evidence of mailing.
How Arbitration Works. Either party may initiate arbitration, which shall be conducted by the American Arbitration Association (“AAA”) pursuant to its Consumer Arbitration Rules (“AAA Rules”), as modified by this Arbitration Agreement. The AAA Rules are available on the AAA’s website www.adr.org, or by calling the AAA at (800) 778-7879. In the event the AAA is unavailable or unwilling to hear the dispute, the parties shall agree to, or the court shall select, another arbitration provider. Unless you and Peet’s agree otherwise, any arbitration hearing shall take place in the county of your residence. If you live outside the United States, any arbitration will take place in Alameda County, CA. Except for a dispute determined by an arbitrator or court to be frivolous, brought in bad faith, or where the initiating party has failed to follow the pre-arbitration dispute resolution process above and/or has not included the notice of dispute and proof of mailing with the arbitration notice, Peet’s will pay all filing, administrative, arbitrator and hearing costs and waives any rights it may have to recover an award of attorneys’ fees and expenses against you.
Waiver of Right to Bring Class Action and Representative Claims. All arbitrations shall proceed on an individual basis. The arbitrator is empowered to resolve the dispute with the same remedies available in court. Although any damages award must be individualized to you, the arbitrator may award public injunctive relief if you are resident of California. You and Peet’s also agree that each party may bring claims against the other in arbitration only in your or their respective individual capacity and in so doing you and Peet’s hereby waive the right to a trial by jury, to assert or participate in a class action lawsuit or class action arbitration, to assert or participate in a private attorney general lawsuit or private attorney general arbitration, and to assert or participate in any joint or consolidated lawsuit or joint or consolidated arbitration of any kind. If a court decides that applicable law precludes enforcement of any of this paragraph’s limitations as to a particular cause of action, then that cause of action (and only that cause of action) must remain in court and be severed from any arbitration. This Arbitration Agreement survives the end of your participation in the Program, whether by cancellation, termination or otherwise.
Governing Law and Other Terms. This Arbitration Agreement shall be governed by, and interpreted, construed, and enforced in accordance with, the Federal Arbitration Act and other applicable federal law. To the extent state law applies to any aspect of these Terms and Conditions, or to any disputes and claims that are covered by the Arbitration Agreement, the law of the State of California will govern. Except as set forth above, if any portion of this Arbitration Agreement is deemed invalid or unenforceable, it will not invalidate the remaining portions of this Arbitration Agreement. Only the arbitrator is authorized to make determinations as to the scope, validity, or enforceability of this Agreement, including whether any dispute falls within its scope. However, the parties agree that any issue concerning the validity of the class action/representative waiver above must be decided by a court, and an arbitrator does not have the authority to consider the validity of the waiver.
19. DISCLOSURE OF INFORMATION TO THIRD PARTIES
To the extent permitted by law, we may amend these Terms and Conditions at any time by posting updated or revised Terms and Conditions at peetnikrewards.com. Please check the Peetnik Rewards Terms of Service frequently for any updates or revisions to these Terms and Conditions. Unless otherwise indicated by us, any amendments shall apply to any transactions occurring on or after the effective date of the amendments. Except where prohibited by law, receiving Points or redeeming any Points, Rewards, Bonuses, or Promotional Offers after the effective date of any amendment shall confirm that you agree to the amendment. If you do not agree to an amendment, you must cancel your membership in the Program in accordance with Section 15.
